Approved Mental Health Professional CPD Update #2 – ‘Interfaces’

Course Outline:

As well as overviewing key legal developments of relevance to the practice of an AMHP, this course explores relationships of the Mental Health Act 1983, together with likely effects of the Mental Health Act 2025, to related legislation and guidance. Specifically, delegates will address working as an AMHP with the Care Act 2014, Mental Capacity Act 2005 (with an update on the long-awaited 2019 Amendment Act) and statutory guidance / Codes of Practice. Essential case law as to these interfaces is also included.

Delegates will also have the opportunity to meet and discuss these matters with other AMHPs while achieving a proportion of their yearly CPD requirement.

The course learning outcomes below give a good idea of the coverage of the course, which is one of four written specifically for the purpose of updating AMHPs in line with statutory and best practice requirements. All courses are also directly relevant to the Professional Standards AMHPs are bound by within their roles.

Key Learning Outcomes:

  • Distinguish overlaps and differences between the Mental Health Act 1983 and the Mental Capacity Act 2005 as relevant to the role of an AMHP
  • Explore the human rights contexts of the MCA and the MHA with particular consideration of the core legal principle of Art. 5, the right to liberty
  • Consider the place and importance of the Care Act 2014, the Care and Support Statutory Guidance and key case law when carrying out assessments under the MHA
  • Review the statutory safeguarding provision of the Care Act 2014 and its relationship with the MCA and MHA
  • Review developments in case law over the last year and any changes to AMHP practice
