Court of Protection Introduction – Powers, Roles and Responsibilities

Course Outline:

This course is designed to introduce those who are not necessarily familiar with the workings of the Court of Protection to the role of the Court and its powers. The course will enable professionals to identify when it may be necessary to make an application to the Court and what application is appropriate. The course will also assist professionals to understand the factors the court considers when granting orders or making declarations.

Health and social care professionals are often faced with making decisions that affect people’s fundamental rights and freedoms. The Mental Capacity Act 2005 is a single piece of legislation covering both the legal nature of capacity and the legal framework within which decisions can be made on behalf of those who lack capacity.

Even though the starting point of the Act is the principle that a person must be assumed to have capacity unless it is established that he or she lacks capacity, if that is established the Act allows many people including health and social care professionals and the Court of Protection to make a decision.

The Court of Protection sits at the heart of the decision and is the cornerstone of the statutory framework.

  • Describe the role and jurisdiction of the Court of Protection
  • Identify the range of applications that can be made to the Court of Protection and the powers of the Court
  • Describe the different Judges who sit in the Court of Protection and the Appeal Structure together with other people involved in the Court Process
  • Consider the relationship between the Care Act 2014 and/or the NHS Act 2006, public law and the Mental Capacity Act 2005
  • Understand the role of the Professional within the Court
  • Consider the importance of the participation of the person in court proceedings
