Since the 2011 case of Jones v Kaney where the Supreme Court removed blanket immunity from suit for expert witnesses, solicitors are increasingly requiring experts to obtain adequate professional indemnity insurance before instructing them. Experts should carefully check whether their existing professional insurance policy is wide enough to cover them acting in an expert witness capacity and, if not, obtain additional cover before commencing expert work.
