Expert Witnesses currently enjoy immunity from suit in respect of their performance in the witness box and contents of their reports. However, this may change if the Supreme Court decides to hear an appeal later this year in the recent case of
Jones v Kaney [2010] EWHC 61 (QB). It may be that expert’s immunity may not survive in its current blanket form, which may affect the levels of Professional Indemnity Insurance required by expert witnesses.
